Conflict with brother, over investment. I gave $5000 for down payment andr closing costs for the house, and we would split 50/50. ?
We planned to sell the house in 3yrs. With him paying the mortgage, he would pay as much as I did with principal, and if he stayed would buy me out. Because he wanted to stay and instead of just repair and only replace what was needed to get the most money when we sold. I would pay 30% of all repairs, and when he refinanced or sold the house I would get 30% of any profit. I was working with the Military out of the country 3-6 weeks at a time. After 5yrs he told me he was ready to refinance, and I said, great, Are you going to buy me out. He said yes. Then it took almost 4 months to find a bank and a new loan, for what we owed on the house, my buyout, and a little extra for him. The value of the house was now 125,000. we then owed 60,000. So the profit minus the new closing costs was 60,000 and my 30% would be 18,000. I came back home he sold the house to himself with me off the title, by putting me down as dead. He said, he could not afford to take a lot out of the house. But later found out he took out 40,000. I told others what he did. I told my brother I needed 5000 now and we could figure out the rest. Later he said, I forgave the rest for the 5000. Recently his best friend offered me 60 for 2 jacks, saying they might be worth 300, but were house jacks worth 2000. When I got made he said he would split what he sold it for, but instead reminded my brother what I said years ago. My brother says I never gave him any money for the house and cheated him.

That is legally true.
The rest is not in writing, can't be proven, and legally never happened.
Note: I did NOT say you contributed $500 for the down payment. I said you GAVE $5000, PERIOD.

That would be 100% irrelevant if true.

Not even an INCOMPETENT title agency would fall for that without an actual death certificate.
