1. A civil servant must be granted prior approval before engaging businesses outside his/her ordinary duties. Failure to do so may face disciplinary actions.

While they are not normally approved, generally the outside business must not be related to the ordinary duties.

2. A misconduct charge by ICAC can't be supported by a simple fact of outside businesses. Instead, the government must be impacted in some ways in order for the charge to be substantiate.
