長命契一問,對方去世前送贈了業權給女兒?

大家好,我既祖母十多年前用送贈形契形式將物業比左我同我呀伯,而本人既業權則以信託契形式,由呀伯托管。

信託契係律師樓做,已經係土地註冊處註冊左,但就無載入土地登記冊上,所以好似隱左形咁,係土地登記冊上只有我呀伯個名。幾年前呀伯過左身,係佢過身之前將整個業權以送贈契既形式,轉左比佢個女,當時我不知情。實情係,佢想搵我轉返個業權,但我一直失踪。因此,現時田土廳上面只有佢個女個名。我想問,係咁既情況之下,我應該仲有冇業權呢?如果有,我可以點樣攞返我既業權呢?謝謝

1. Yes, assuming you are still able to retrieve all relevant document. At the minimum, the trust document.

The law firm, as well as whoever is holding the lease, should have the document (the trust document is required to attached to the lease).

2. There are 2 ways:

a. If your cousin is willing, she simply need to transfer the 50% back to you (assuming the Land Registry reports she owns 100%).

b. If she is not willing, you will have to prepare to use the document, including lawsuit (However, based on the scenario, it is unlikely to come to this).
