未辦繼承前,可推定都是繼承人。把所有繼承人都告了後,再來逐一刪除放棄繼承的人。

Because the liability has not yet confirmed, you will need to sue the named owner currently on record first regardless the owner is dead or alive.

Without the actual lawsuit, you won't be able to secure your loss and/or force the owner's family to resolve.
