目前層樓有按揭,如果想賣樓,是否應找律師先檢驗目前樓契是否妥當才決定簽臨约? 如萬一簽了臨约甚至正式買賣合约後才發現楼契有問題而又成交唔到,是否要向買家作出賠償? 始終我們外行人,也從來未見過樓契。?

Banks usually take extra cautions for the properties subject to mortgage. So when you are able to obtain mortgage for the property, it means the bank has examined to situation and no problem has been found.
2. No. Generally, a provisional agreement only requires the sellers to return the deposit back to the buyers in case of any involuntary cancellations of the transaction.
