The American system of government was not based on divided power, it was based on LIMITED power.
Our Constitution is significant in history because, where other state charters existed to affirm the right of the state to define and assign powers, ours was specifically created to define what our government could NOT do infringe upon NATURAL rights.
The "checks & balances" system was put in place to ensure that no one function of government (the legislature's responsibility to the People...the executive's responsibility to the States and the judiciary's responsibility to the Law) became all-powerful via the reminder that each is ultimately responsible to (not empowered by) The Constitution.
