It is illegal to fire someone while they are out sick, BUT that does not prevent the employer from firing them the minute they return back to work.

No. Unless you can prove that it’s discrimination against the flu.

If you used up all your sick and vacation days then you take off for the flu, you can expect to get fired if you can’t get someone to cover you.

If you do not qualify for FMLA, then it is legal for the employer to let you go if you are unable to perform your job.

There's no criminal law against it however if you have proof that you had the flu from a doctor's note you can sue your employer for wrongful dismissal and the judge will award you a certain amount of money for each day that you're out of work having to look for a new job also unemployment will pay you because you had a legitimate excuse.

probably not illegal. a written employment contract would likely make it illegal, but most workers don't have one
