Can someone work for me every day and be paid as a sub?

I am starting a business moving mobile homes and I need someone to run the pilot/escort truck. I asked a friend of mine if he wanted the job but he says he wont do it if he has to use his own vehicle. I am under the thinking that if he doesn't use his own vehicle with his own expenses I cant pay him as a subcontractor. I am not looking for a employee just someone to escort me a couple days per week. If I buy a vehicle and cover it under my insurance and such can he run it and still be paid as a sub contractor....legally? This could potentially turn in into a situation where I am working him every day but, I'm not looking to hire a employee. At least not at first. Is there some way around this? I'd like to stay fairly legal. Thanks

You should clear this with the IRS. They will likely not agree to your agreement to hire your friend as a sub.

You have to pay him as an employee if he's using your equipment. Easier to do it right than face the penalties for not having workers comp etc. Your insurance company would also take a dim view of a non-employee driving a company vehicle.

You are looking for an employee. A part-time employee.

There is no way your friend would qualify as a subcontract even using his own vehicle. He doesn't do this business for anyone but you. You are dictating everything about it.
