Will the post office pay for my broken statue if this ebay seller doesn't pull through?

Cape on my statue I got from ebay broke off during shipping. Seller offered to send me a $25 refund but has yet to send it? Will USPS pay for the damage?

No, the post office is not in any way liable and will not pay, unless the package was insured.

If the seller doesn't refund voluntarily, you need to open a claim with eBay. There's a time limit to do that. Don't delay.

Some shipments such as via priority mail can include a minimum amount of insurance. Otherwise you have to pay for it separately. It's the shipper who purchases it. It's for them to submit a claim with the post office.

It might be something where you accept a partial refund through eBay if you want to keep the item. Otherwise you're going to need to send the item back to get a refund, and they can file the post office claim if there was insurance.

The post office is not going to refund you. They'll offer to hang onto the item so that the buyer can submit a claim (if there was insurance), and they keep the item.

If the shipper insured it, they can file a claim. As the recipient, your only recourse is with the shipper, not the delivery company.

If you paid for insurance, you will be refunded or you may be able to negotiate a partial refund for the damage. If the seller does not pull through, report it to eBay. When they see the damage, they will refund you but, you will have to return the item. If all you want is a partial refund for the damages, it's a little trickier. eBay doesn't like to deal with anything but a straight forward return. It may get to the point where you have to decide whether or not to return it.

Highly unlikely. If you've ever tried to get the USPS to pay for damage, you'll know what I mean. It's like pulling the teeth of a wide awake lion.

Unless insurance was PURCHASED when the item was mailed, the post office won't even bother to LAUGH at you.

It's up to the seller to have insurance for their loss at any point prior to your taking delivery. You file your demand with the seller. If they can prove the USPS caused the damage, that's between the shipper and the USPS and literally none of your business.

It is part of the UCC (Uniform Commercial Code) that the seller is responsible for risk of loss or damage until the merchandise is in the hands of the buyer. You should be looking to the seller to pay for or replace the merchandise. A wise seller always insures anything shipped to a buyer and should be able to collect on that insurance but the seller ultimately is responsible to the buyer for the condition of goods received.

You file an eBay case you don't ask the seller file an eBay case through the resolution center and asked to return the item the seller will have to give you a return label to return it for free
