The police charges suspects based on evidence. Even you refuse to testify, it does not mean the police does not have a case.

Bottom line - you can refuse the testify. At the same time, the police is free to determine if they have enough evidence to press charges.

家庭暴力案件的受害人報警求助，可能沒有思索長遠後果；有些情況則是鄰居聽見爭吵聲而報警，因此，受害人可能不願意擔任控方證人。如受害人不想作證，應盡快告知警方，最理想的做法是即場告知。是否起訴疑犯或是否繼續調查案件由警方決定，但警方亦會考慮現實情況，而受害人願意合作與否，將影響證據的充分程度及定罪的可能性。如沒有其他證據，受害人又不願合作，警方便可能會放棄起訴或終止調查。
