Statutory civil damages release?

" In consideration of the payment of 200.00, the payment of which does not constitute an admission of liability, walmart hereby releases ( Name here) from any and all civil theft claims, civil suits, civil causes of action, civil damages, related civil actions, etc., which has,had,or may have against (Name here) arising out of the alleged incident in the Walmart store on (Date of incident).
This release does not apply to claims for restitution which the store may have against (Name here). Should payment be disputed, contested, or stopped, this release will be null and void. This release is not intended to have any bearing on any criminal claims that are or may be pending.

Are they allowing this person to go back into walmart to shop?

All that waiver does is release the person from any and all civil theft claims, civil suits, civil causes of action, civil damages, related civil actions, etc.

If they have been otherwise banned from the store they are still banned.

The release means that in exchange for $200, Walmart will not file any civil suits against the name person except for restitution. And the person does not have to admit any wrongdoing. But it doesn't mean this person can't be charged with a crime. It doesn't ban the person from Walmart, but it doesn't mean this person is welcome at Walmart anymore.

yes. walmart gives up all civil remedies, except restitution [payment for value of merchandise].

criminal charges are not within their purview once filed ... they belong to the DA

This sounds like a standard settlement of a disputed shoplifting claim or a claim against a customer or employee. It's good and it holds water legally.

That letter does not address the ban from the store either way. As such, any ban remains in affect.
