They won't order the person to get a job, but they WILL order them to pay child support based on what they are ABLE to earn.

The court will determine what he is able to bring in,and will assign that amount. Even if he is on public assistance, he will owe something.

Arrears don't go away. Go ahead and file for support, and if he doesn't pay, open a case with the child support enforcement unit.
