My mouse receiver was infected, can I sue the manufacture?

The mouse receiver firmware had been modified via (badusb) flaw. I have the logs and isolated it down. After I removed the USB my PC was fine. I was lucky enough to have caught it in time, but if I hadn't, all my firmware would have been infected.
The usb port itself has been modified, so I can no longer use that port, otherwise any USB device I plug in will get infected.

This is exactly what Snowden was talking about; This is an example of NSA malware.

No its not! NSA don't use malware, they don't need to! It's just normal, nasty, malware.

Uh, a USB port is nothing more than 4 wires connected to a metal bracket to hold the USB plug. There's nothing in a USB port that can infect devices.
