So my teacher told me to talk to him and he said "if I were to open up your phone and look true your text will that be a problem" and I said "I mean it depends" and he commanded me to give me my phone. Does he have the right to do that?

No, not unless there is reasonable suspicion of illegal activity. If you were using your cellphone in a manner that the teacher believed was disruptive, the teacher must follow school policy. Typically, school policy would only allow the phone to be confiscated if the teacher believe that it was disruptive to the learning environment. Teachers do not have the right to read a student's text messages or to transfer texts or photos from the student's phone to the teacher's phone. Either you or your parents may want to request a copy of the section of the handbook the teacher is referring to. You may also want to inform the teacher's supervisor of what happened.

Usually no unless he suspects you have been doing something wrong in class. Even that, you need another teacher or supervisor to be present.

On school property he does, if the school policies allow him to. Otherwise, no.

It's illegal and out of his place as a teacher to go through a students personal belongings. A cop can't even do that **** with out a search warrant
