Car hit from behind? Who's fault? UK?

If your going up on a steep hill and a car behind you is very close to your car and his intention is you hit his car.
Would this make it my fault for hitting his car since he was very well aware that parking to my car will hit his car as my car rolls back.

Where do I stand on this? Will it be my fault?
That driver should stay distance especially going in a steep hill.

Wait. If you back up into the vehicle behind you, that doesn't count as being hit from behind. It counts as backing into a parked car.

Parked vehicles can't be at fault for anything. When you back into something, it's the fault of the only vehicle that was moving at the time. That's how it works in the UK and anywhere else in the civilized world. The only mistake the other vehicle owner made was failing to realize that you can't control a vehicle properly, which doesn't count for anything.

When you back into a parked car, the only place you stand is 100% liable for the damage.

You rolled back in to him its your fault, handbrake take offs prevent this you should be able to take off on any hill without rolling back at all be it a manual or auto trans car.
