1. 唔駛坐監，但要罰款；2.可被檢控或處以行政罰款港幣二千元，另加有關應課稅品須繳稅款的5倍，即每支超額香煙稅款是HK$1.25 X 5倍 = HK$6.25 ，數額是 HK$6.25 x 1181 =HK$7381.25， 再加行政罰款港幣二千元，盛惠 HK$9381.25 。
