香港高等法院点先決定用陪審団？某D案(殺人，強姦)係唔係—定用陪審团?

There is no law or rule requiring trial by jury. In fact, the Court of Appeal acknowledges that there is no constitutional right for jury trial in Hong Kong.

In this case, whether a case is eligible for jury trial rests upon the Court only. For proper use of resources, the Court will only request jury trial for complex cases only as the jury will be served as the trier of facts.

根據《陪審團條例》：高等法院原訟庭的刑事案件審理必須有陪審團，輕微的犯罪行為（簡易罪行）的案件不適用陪審團審理。換言之，最嚴重的犯罪行為由高等法院原訟庭審理，而不是在下級法院中審理。法律明文規定的犯罪行為、刑期最重可達七年以上徒刑的犯罪行為，或者法官及陪審員審理該案符合公眾利益的案件，皆於高等法院原訟庭中審理。
