幫朋友一問，簽左一年死約後出現財政問題，好不容易到最後這三個月，朋友苦求用2個月按金當租金，最後那一個月的租金在租約期前會盡快付清，業主口頭同意了。但今天於大門前貼了一張土地審查處發出的信，說朋友由6月開始欠租，要告我朋友。 想問一般情況，口頭承諾都可以的嘛﹗可是我朋友沒有錄音…?

There are 3 major issues, which all of them work against your friend:

1. Regardless, nonpayment of rent is conclusive enough to be considered as a breach of agreement;

2. When an agreement is in writing, it can only be changed in writing (the verbal agreement is invalid in this case);

3. Even the verbal agreement was valid, your friend can't prove its existence.

So your friend has only 2 options:

a. Arranging a moving out with the landlord; or,

b. Pay any outstanding rents (if the landlord is still interested).
