Should I pay the settlement offer? Will they take me to court?

My daughter got caught shoplifting and they called the cops to take her home but she called me and I called my aunt to bring her home and she paid for the object which was less than 5 bucks and a couple of weeks later I got sent a settle meet offer for 300 dollars do I have to pay it.?

What you got is called a Letter of Demand.
The way this works is that you are offered a private fine to pay, or their next step will be to report the theft to police. That would mean your daughter going to court, which also involves court costs, and while it was a very minor theft, you would still have to attend court, pay the court fine, and then it would be on her record until she reached 18.

You have an opportunity to teach her the ramifications of crime now- if she were my child, she would be grounded except for work opportunities until the entire $300 was paid off. It is her bill, so let her work it off. It's enough to protect her from having a record.

No you don't have to pay the civil demand, but if you don't they will take her to court and then she will get a record........ civil demands save then the time and cost of court action and saves her a record

You can ignore it and see if they are just bluffing or not. But if they are not, your daughter will be the one getting in trouble, and criminal shoplifting charges might be filed against her.

So in other words, shop lifting is o.k. as long as you pay for what you steal and only when you get caught? Wow. That is what you are implying.

Pay up because an attorney will want a retainer of at least $2,000 to settle this.

If your daughter has time to shop lift then she has time to get a job.

What they are doing is called a civil demand. It is cheaper than court and it helps them recoup losses from all the times they don't catch the shoplifter.

no there is a big difference between criminal and civil damages, and you can have an attorney respond to their demand letter.

What you got is a civil demand letter. Ignore it. It is very unlikely they will do anything about it and if they do you can negotiate at that time.
