By the term of that agreement, the purchaser is obliged to pay $5000 earnest money within 60 days, and the vendors are entitled to forfeiture in the event of default by the purchaser.

No, it's used correctly. Forfeiture is a noun, the act of forfeitting. The buyer puts down $5000 and forfeits it if he defaults.
