基本上案件都會由「警方」繼續控告下去。刑事案件中原告人並非受害人，是「律政司」代表香港政府代表香港人出庭起訴被告，案件則由「警察」交律政司，律政司再決定是否起訴。
警察責任在於負責舉證，受害人即使起訴過程中想要撤銷也不能，除非證據不足或律政司撤控，法庭一般都會繼續審議直到結案為止。
