Seems that Standford owns the patent before, which according to the Baye-Dole Act the IP belongs to the research institute and faculty, provided that they are federally funded

What difference does it make who funded it? Either the inventors worked for the University or they didn't. If it's federally funded, the US government might have certain royalty-free rights to practice the invention.
