請問我間屋被人投訴漏水,政府出信我要期限內維修,而間屋租緊比人,我們要進去維修但租客不肯合作,這種情況我該怎麼辦?

Although not specified by the Hong Kong Ordinances, the lease and the common law allows a landlord to access its property in a reasonable manner (for example, potential new tenants/buyer). Furthermore, the tenant must also allow the landlord to access for necessary repairs.

So when the tenant is uncooperative, the only solution is to terminate the lease and evict the tenant for cause, even it means you have to sue the tenant.

But keep in mind - even you are allowed, it does not mean you are not liable for any inconvenience caused to the tenant. For example, if the repair takes a week, you will have to address, usually in a form of monetary compensation, the tenant's inconvenience.
