When Does My Maternity Leave End?

My estimated due date was 2/5/16 for full 40 weeks term
I had my son early at 36weeks so he was born on 1/8/2016

I also went on my leave early due to some pregnancy complications so i started 12/22/15

went on medical leave before maternity leave.

Ive called my HR and she is from different country and not sure how it works,
so im trying to find out some information

chatted with a friend and she said i would go by the orginal due date which is 1/8/2016

so would i go by 1/8/2016 or 2/5/2016???

would appreciate any information.
Oh and i had C section which means in California its 8weeks of maternity leave.

and we didnt apply for family leave to extend it just regular maternity leave.

It's 8 weeks from the day the baby is born. So it would be 8 weeks from 1/8/16.

Your maternity leave it up to your employer.

You would likely qualify for eight weeks of MEDICAL leave from the date of your section, since it's very uncommon for a doctor to clear you to return to work before then. Your actual maternity leave is counted from the day you first took off work.

California does not offer eight weeks of maternity leave for a section. That is medical leave. Maternity leave is a federal allowance, which is twelve weeks. (Medical leave is as well, it's FMLA, but medical leave involves the doctor's clearance, maternity leave does not.) Unpaid - if your employer chooses to pay you that is up to them. If you qualify for medical leave payment, it can either be through your employer or the county.
