你沒錯 它撞到你你幹嘛賠錢? 實質上肇事者應屬行人 不管你有沒有撞到他 但確實是因為他闖紅燈而你剎車不及而摔車導致後方來車閃避不及 至於車速快不快或後方車有沒有保持行車距離 這實在很難定奪 就算調出監視器也未必能正確研判.....誰知道那路人是在你距離路口多遠的距離衝出來的....若是在差沒幾秒的距離呢?? 任誰都有可能會先嚇一跳再轉向急剎導致摔車 舉個實際的例子 我之前也是騎車準備要過一個紅綠燈口 因為一台貨車闖紅燈 當時我距離路口只剩大約2公尺 急剎摔車 貨車跑掉 (因為他不曉得有人因為他闖紅燈而摔車) 後來我報案 雖然警察說因為我沒有直接跟它撞上所以不構成肇事逃逸 但是可以跟它索取賠償費用的.....所以你的例子我覺得不需賠給後方車輛....要也是他要賠你 當然!!還是以警方或交通大隊來裁定
