How much money would my mom make off a divorce?

my parents are getting divorced and i want to know how much she'll make

she has 4 kids (21,18,16,14) and we reside in new jersey. my father commited adultery and my mom retaliated by basically stealing his money.

how much would she be taking from him?

My guess? Mom would not make much money at all. During a divorce proceeding, the general idea is to split assets as close to 50/50 as possible. So you start with the general idea that HALF would be HERS. However, you state that your mom already stole his money. That is very much frowned on by judges. During a divorce proceeding, your mom would (at a minimum) be ordered to pay back the money she stole. In fact, she might be penalized for being so greedy. In other words, she might lose a lot MORE than the money she stole.

Your father would be on the hook for two years of 50% child support and another 2 years of 25% child support. If he has a decent income, he could be on the hook for about $500 a month for two years and then $250 a month for another two years...

As for how much money would your mom make off of a divorce? Not much. Unless your family was rich to begin with, she's going to end up with 50% of assets....or a lot less maybe. So her lifestyle will be negatively effected. Yes, she will get child support. But it won't cover the cost of actually caring for the children. And it's not meant to. Women owe child support, also. People forget that. People are always focused on how much the man will pay to the woman for child support, but the actual child support is based on income of both parents, and both parents pay child support.

He will probably have to pay child support for the underage kids who are 14 and 16. Beyond that, it will depend on your parents' finances and other circumstances, which we know nothing about.

She won't make ANY money.

This is what happens.
Whatever dad owned before marriage, he keeps.
Whatever mom owned before marriage, she keeps.
Whatever came into the marriage DURING the marriage (except any inheritances) do NOT belong to the individual but belong to the marriage and will be split 50/50.
Mom will NOT get alimony.
She will have to go out and get a job.

Up to HALF of what it costs to support the 2 kids who are still underage will come from dad, and mom will have to supply the other half of it. There will be no provisions made for the 18 and 21-year olds, since both of them are now legally adults and neither parent is legally obligated to support them anymore.

Child support is NOT money for mom. .. .it is money to help feed, clothe, and house the kids, and that is what it is to be spend for.

The Courts do not care if he cheated or not. This is what "No-Fault" divorce is about . NO one gets their wrist slapped for cheating. No punishment, no extra money awarded. It just does NOT matter any more and all States have No-Fault divorce now.

You mom could NOT steal "his money". Legally it isn't his, and it isn't hers. It belongs to the marriage.
But if she TOOK the marriage-money, she will have to hand it back .. not to him, but to the divorce proceedings. It will be split between the two of them.

Unless she took money that was not her's then that is stealing and he should report it to the police. If it was in a JOINT bank account then that isn't stealing. She withdrew money from the account. She also has bills to pay such as the house you all live in, the heat/water/electricity you use, the food you eat, the clothes you wear, the car that goes to get those things along with taking you to school/events, etc... So she NEEDS that money. It is called child support and in this case most likely alimony if they have been married long enough.
