One does not need to fall in love with someone to file for divorce. That is a matter of whether the person wants to continue married.

There's no such thing as a "right" to divorce. In this day and age (at least in most western countries), you need no other reason beyond "I don't want to be married anymore" to get a divorce. This means that any married person has the "right" to file for divorce for any reason whatsoever. You can judge him morally wrong for doing so in the situation you describe, but legally, he has every right in the world.

A married person has the 'right' to file for divorce for any reason they choose, whether someone else is involved or not. Nobody should be required to remain married if they don't want to be. It's not supposed to be a prison sentence, although at one time some people viewed it that way (when the marriage was unhappy but divorce was too taboo to consider).

he does have the right just like any other person to file for divorce. Unfortunately he should not have been married or had children..he sounds like he is a man or bloke that is not happy with himself to not be able to sort out what he wants...His children are right in the middle of this situation and how unfair...I hope for his sake he can learn how to grow up as he has not so far...maybe he should be talking to his children about that....

Of course he can. Even though it's his fault the marriage didn't work out he still has the right to file for divorce. The reason would be he doesn't love his wife anymore which is a common reason for divorce.

Literally, yes he does have the right. Legally you can divorce because of that. However, if that is morally correct depends on your own personal opinion. Sounds like a sticky situation, why stay with someone when you are in love with someone else, but getting a divorce would cause problems for the kids. If you're literally asking if he has the right, then yes he does, but if this is a moral question then there is not factual answer, only opinion, so there is no correct nor incorrect answer.

You bet. Any spouse can file for divorce. And the government will grant it to you, too. There doesn't even have to be much of a reason, either. But it takes some time. So plan ahead. Money issues usually foul up the process. And divorces usually chew up money you don't have.

he will probably be doing the same thing over and over again but if thats not the case, he has every right to leave but he NEEDS to think of the impact this will have on the 2 kids. The KIDS should always be put first infront of the needs of the parent, he chose to have the children so he cant be choosy on who you want to be with. Also the children have no choice in this matter... when it affects them the most.
