The plaintiff pays to file the papers in court. He pays the sheriff or a private process server to serve the summons on the defendant. After trial, the party that wins may be entitled to recover certain costs of the litigation, so a plaintiff who loses may have to pay defendant's costs.

There are only certain kinds of cases that a lawyer can take on a contingent fee basis, like accident cases, and the lawyer has to be pretty certain the case is a winner before he agrees to take it.

Yes, the party that initiates the action has to pay the filing fee. If you are successful, you can ask the judge to include the court costs in your settlement.

If the lawsuit is for a substantial amount, you can probably find an attorney that won't charge you unless you are successful. The lawyer will then take a percentage of the settlement.
