回收土地區域法院之司法管轄權?

區域法院條例第35條指應課差餉租值(以最低者為準)是指土地每年的租金或按照確定的應課差餉租值,或其年值2選1,對碼?。
若確定的應課差餉租值248,000,每年的租金156.000,請問區域法院有否司法管轄權?

凡土地的每年租金或按照《差餉條例》(第116章)確定的應課差餉租值,或其年值(以最低者為準)不超逾$240000,區域法院具有聆訊和裁定收回該土地的訴訟的司法管轄權。

1. No. In fact, there is 3 choices:

- Annual rent (每年租金)

- Rateable value of the land, determined in accordance with the Rating Ordinance (Cap 116) (按照《差餉條例》(第116章)確定的應課差餉租值)

- Annual value of the land (土地年值)

2. The answer is conditionally yes.

When a case is under a hybrid jurisdiction, the party claiming the proper jurisdiction must show prima facie evidence to establish the jurisdiction. In this case, the party claiming the District Court jurisdiction will need to demonstrate a legitimate lease (with stamp duty paid) to the court.

Also - the court can decide not to exercise its jurisdiction if the court has determined the reliefs seeked will exceed the court's jurisdiction.
