本人及太太居於香港. 1993年取得居英權並己於今年2月取得英國護照. 幼女於1994年5月香港出生. 自2012往英國求學, 將於明年畢業.

幼女於今年3月在英國原想申請英國公民護照 (British Citizen passport), 己提供了母親的居英權正本, 出世纸正本及父母的英國護照no.作申請. 在並申請表上選了 " first British Passport" 及交回過期未續的BNO 惟新發出的護照只是新BNO(overseas)

現欲於香港再上綱再申請British Citizen Passport. 有如下問题 :

1. 申請中問及幼女是否a British national at Brith, 我們的情况是否答 : yes? (因幼女出世前我和太太己有居英權)
2. British Passport 是否一定指British Citizen Passport 而不是BNO (overseas),etc
3. 居英權証書上右下角有"Section " no. (我的是 1 (1), 太太則是 1(4). 這對申請可有影响?

The answers are based on all previous questions and responses.

1. Yes. She is a dual British national - BN(O) and BC.

(There are 6 different kind of British nationalities. As soon as you have one, you can claim you are a British national. That's why almost half of Hong Kong residents are British nationals.)

2. Yes, in 2 reasons;

a. She is applying for her first passport. Therefore, she does not have a British Passport for the purpose of this application.

b. Your BC Passport is what establish her citizenship by descent.

3. No impact.

I am not certain as that could mean something. However, since you are primary for the registration and you are registered as otherwise by descent, it makes no impact to your daughter.
