法律: 口頭協議租住問題

我母親是業主,因將會離港2-3個月,口頭答應讓朋友的女兒暫住家中,幾時入住及離開沒有說明。而朋友的女兒答應會付管理費,水電煤及每月二千元屋租。母親已交匙給她。

經分柝後我認為當中太多問題和顧慮,想拒絕此人入住。如果現在換鎖及堅拒此人入住,會有法律責任嗎?

此女子尚未入住,所以沒有任何財產在母親家中。

就咁既,對方係可以報警,因為你係冇權扣起人地d財物.

你換鎖係冇問題,你仍然係法律上既擁有人,但通知番對方,安排番個時間去執番d野就可以,大家好黎好去咪算lor.

一切負面的想法,都會將閣下的母親,放在失信於人的位置上,這是人際關係的大忌。
另外,物業持有人的決定,無需旁人分析。正如,閣下的老闆,下達的命令,是給公司內的員工執行,而不是讓他們去研究。

The answer is no.

In Hong Kong, any agreements involving real estate must be in writing with stamp duty paid. Otherwise, the court does not have to recognize the existence of the agreement.

In short - there is no agreement existed in this case.

However - the easiest (and cheapest) way to deal with your issue is to sign the lease agreement and pay the stamp duty. In that case, both parties are protected by the law. Morally, you will not damage any relationships with your friends (as you will definitely lose a friend if you change the lock).
