離婚物業業權問題查詢

本人與丈夫現有一聯名私樓各50:50擁有權, 現市值約800萬, 現相方同意要離婚, 丈夫無條件將50%業權轉名給我。律帥轉名費約$5000~8000. 但政府按市價收2.25%厘印費即$90000. 我們不想付這筆轉名厘印費,能否避開這$90000收費呢? 若先攪離婚老公轉贈物業權比我,之後我一直5去做物業轉名但繼續出租/賣買又有咩問題呢?

2. The HKSAR Government will still be able to collect the same amount of stamp duty with a penalty.

Remember - the transfer is based a divorce proceeding (which allows a lower stamp duty scale to be used). Court records or decrees will show when you have the actual control of the property.

Avoidance is not practical.

3. Not exactly. Fair market value is the amount that can raise the least disputes. For example, in your case, you can claim the property is valued at $6 million and IRD can value the property as $10 million. As there is a variation in value estimation, fair market value is used to avoid any disputes (as it is the price a competent person is willing to pay for the property).
