1)破產債項利息利率及時間2)受託人賣樓限制3)空置管有權

本人於2008年獲破產解除令, 2013年受託人向法庭申請賣樓, 本人有以下問題 :

1a )這個訴訟是不是有時效限制 ?

1b) 破產後債項利息利率是怎樣計算 ?
是不是要跟據銀行利率計算?
我可以反對嗎?

1c) 破產後債項利息計算時間 :
跟據第347章第4條 :
"就任何判定債項的欠繳利息, 則不得於利息到
期應繳的日期起計滿6年後追討";
所以, 計算利息是不是應扣除6年?

2a) 受託人變現破產人樓宇有什麼限制和程序 ?
受託人賣樓是不是只需跟據判決書
判決的價錢 ? 是不需理會市價?

a. No. The main reason is a lien has been filed for your property due to the bankruptcy.

b. It does not matter in your case. The issue is the Receiver wants to sell your portion that you previously owned and forfeited due to the bankruptcy. The only way to resolve it is either comply with the request (selling the property) or buy-back the ownership based on market value (or the money forgiven from the bankruptcy, whichever is the lower).

c. See above.

2.

a. The Receiver must recover in its best effort for the creditors. Technically, you lose your rights once you filed the bankruptcy.
