向部門主管投訴-----算是誹謗罪嗎?

職員甲把自己的工作推給我做,我拒絕,並向部門主管投訴職員甲把自己的工作推給我做,職員甲被部門主管口頭警告,但是職員甲一直否認曾經把自己的工作推給別人做,兩星期後職員甲被公司解僱,職員甲仍然否認曾經把自己的工作推給別人做,要求我賠償他失業的損失,否則會找律師控告我誹謗,由於我當時沒有錄音,難以證明職員甲曾經推卸工作,請問職員甲成功控告我誹謗的機會有多大?如果我要找律師辯護,律師費大約要多少錢?

首先,話搵律師,同真係搵律師,個成本完全係兩件事.

然後係幾乎冇得告,因為控方要完全去證明你講既唔係事實,而有一個實際影響.
咁佢有冇做過,冇辦法證明,公司又係咪因為咁而炒佢,一樣冇辦法可以證明.

仲有一樣野,你只係作出投訴,合理到暈,相反你唔作出投訴,改為去唱佢,咁就差d喇.

波哥前排都有單類似既官司,輸左要賠廿萬比對家.
其實就咁,呢廿萬真係好小錢,前提就係相對於雙方既律師費及堂費,係講緊幾千萬黎計.

所以呢d官司,唔係雙方都有頭有面有d錢,都好難打得成.

Unlike most cases, in defamation cases, defendant has the burden of proof that the speech involved (the complaint to the supervisor) is accurate.

Plaintiff's burden is to prove the speech involved exists. In this case, it is very easy (through the supervisor's testimony and actions). Since you have no recording, the only way to defend is to establish your credibility that you are likely telling the truth and/or the conversation is likely to exist.

Also it will help if the company terminates the employment not related to the incident. Based on your information, Plaintiff will claim that Plaintiff sustained damage due to the speech by termination. If the termination is not related, the damage can't be established even the speech is defamatory.

2. You will be charged per hour. It will be very expensive. In this case, a settlement may save you more.
