1. For the girlfriend, the answer is yes, as the signature on the form concludes the commission payment.
For the boyfriend, the answer is it depends. If, before showing the property, either boyfriend or girlfriend has made any comment that they will be buying together, then the answer is yes.
However, if only the girlfriend is the potential owner and the boyfriend incidentally becomes the new owner instead, then the answer is no.
The complication is there is no legal relationship exists between the boyfriend and the girlfriend.
If commission is needed, the boyfriend/girlfriend simply needs to be responsible for their own share. The seller's share will be paid by the seller.
2. Yes. No.
The agreement to represent can be voided due to misrepresentation. Also, the person affected can seek damages in a court of law and/or file a complaint with EAA.
The issue in this case is the agreement has not been voided prior to the sale. And there is no apparent damage (as the property has been sold not related to the presentation by the agent). The owners can use this to bargain for a lower commission. However, none of this will stand as the ground for non-payment.
