樓上滲水到樓下,業主責任

樓上滲水到樓下,如樓上租客不合作,不肯安排時間維修。樓下告上法庭,樓上業主可否將責任推到租客身上,最低限度將樓下的堂費及律師費轉嫁給租客?有無案例?請各位多多指教,謝謝!

雖然業主多次通知租客及給租金優惠,租客都不肯安排時間維修,業主有何辦法? 是否要終止租約或告上法庭?謝

樓上滲水到樓下,是樓上業主的責任。
由於,香港大廈林立,時有發生這樣的事情,幾乎是香港人的共識。如果,閣下在出租房屋前,多了解業主和租戶的責任和條例,就不會驚慌失措。

The answer is no.

Most standard agreements allow the landlord to force-entry into the property to make necessary repairs upon necessary notice to the tenants. Although the landlord is free from scheduling the visit, the entry is not optional to tenants. In fact, Section 24 of Landlord and Tenant (Consolidation) Ordinance (Hong Kong Ordinances Chapter 7) authorizes this.

Also, the landlord can evict the tenants through the Land Tribunal under Section 24(3)(d) and 33(d) of the same ordinance. Both sections allow the landlord to evict tenants due to tenants' failure to co-operate.

As the landlord negligently allows this (failure to repair) to happen, the landlord, not the tenants bears the full responsibility.

業主是有不可推卸責任維修及管理其樓宇,包括解決滲水問題,如果試圖將責任推給租客是難以得逞的;
