私人地方駕駛車輛問題

無牌駕駛在任何地方均屬違法；

香港法例第374章第22 (1)條，除條例另有其他規定外，所有在附表1指明的種類的車輛，如在任何道路上使用，均須領牌。條例第42(1)條規定，除條例另有規定外，任何人不得在道路上駕駛汽車，除非他持有其駕駛的車輛所屬車輛種類的駕駛執照。

條例第117條（條例對私家路的適用範圍）仍將第42條（駕駛時無執照等）納入規管範圍。因此，在私家路上無牌駕駛同屬違法，如屬首次被定罪，可處罰款$5,000及監禁3個月，如屬第二次被定罪或隨後再次被定罪，則可處罰款$10,000及監禁6個月。

The main reason is if the vehicle is currently regulated by the Transport Department, a person must have a license and proper endorsement by the Department in order to operate.

(In the legal aspects, Hong Kong Ordinances allow road owners to make additional rules for the roads. But it has to be in comfort of the Ordinances, not against, such as driving without a license.)

It is based on the concept of Constitutional law - Hong Kong Ordinances supersedes other rules or law.

What makes it more complicated is enforcement - how can a policeman enforce this traffic law in the private area?

It is illegal. It does not mean the Government is able to enforce.
