警方起訴佢犯左猥褻侵犯罪, 即非禮罪
需要佢下星期三就上區域法院
我親戚單身左一年多, 寂寞多時
佢月薪吾高, 請吾起私人律師打官司
佢曾經聯絡過法援, 法援表示因為個案屬於起區域法院審理, 所以拒絕左
只係比電話佢, 叫佢打比區域法院既當值律師
打去時, 個接線生叫佢當日早15分鐘到4樓搵個主任
就會有當值律師幫我親戚
但照常理, 15分鐘都吾會點研究案情同疑點
我地都覺得, 個當值律師只會叫佢認罪就算
查過非禮罪初犯, 通常都會被判刑座14至28日監
如果一上堂就認罪, 通常都會減刑3分1 ,
(因為減少左處理案件時間, 亦令受害者吾需要出庭, 減低佢回憶吾開心既回憶)
即可能座10日就出獄
我親戚本身做護理工作, 好怕有案底做吾返份工, 吾可以再做呢行
佢平時照顧長者好盡責, 對同事好, 家人好
有返教會, 亦曾經搵過社工輔導, 但佢早前覺得社工講黎講去都係果啲意見
佢吾係好想跟足, 就拒絕左再接受輔導, 結果出左事

The main reason is the choice of lawyer. if your relative hires a lawyer, the lawyer should be able to prepare the court packet to reduce your relative's sentence, such as:
1. A medical report from a psychiatrist (doctor in mental health) will be needed.
a. Psychologist is not a legally recognized professional in Hong Kong Ordinances. Unless the "psychologist" works for a well-known organization, like Hospital Authority or Social Welfare Department, the Court has the right to reject any testimony from the "psychologist".
b. Paraphilia can be viewed at a mental illness. A psychologist, even recongized by the Court, does not have qualification to testify.
2. Reference letters from various organization.
3. Forgiveness from the victim - this is the most difficult. However, this is also the key of sentencing. If your relative seeks no imprisonment, then the victim must express her forgiveness.
4. A treatment plan
5. Resignation letter - as this offense is classified sex offense, your relative eventually will lose the job.

所以依個理由冇咩用
如果有求情信,悔改書等
