car damaged by cabin door?

I was driving out from the site car park where I work in asked the security guard to open the main gate to let me out. He left the cabin not shutting the door properly and the security guards door swung open from the wind which hit my vehicle making a medium size dent in the back left hand side.

I have spoken to the owner of the security company , he has told me that he has spoken to the insurance people and this is not covered under it and will not pay for the repair stating that “it was an act of god” even though it is down to the negligence of the security guard not securing his door properly.

Am I right believing that due to the security guards negligence the security company should pay?

Any court cases to strengthen my argument would be apprishiated

Your insurance company should be working this out with their insurance company.

Doesn't matter what their insurance says, they are still responsible.

You gave them a chance to deal with it like adults. They said no, acting like children denying blame. Now you send them written demand for repairs, certified mail, and sue them if they refuse to pay.

Or, just as a suggestion, you let your own insurance people deal with it.

Insurance companies don't make money by paying out claims freely. They make you work for it. They have specially trained minions whose entire job is to REFUSE to pay, perhaps in 27 different, mind-numbing ways, while at the same time saying they're helping you.

You can bypass a lot of that stupidity by simply suing them immediately, meaning someone at a much higher level has to get involved and make a settlement decision.

yes it was negligence not an act of a god. I would ask which god is he referring too? I also think the guy is lieing. Ask him for his insurance information. He has to give it to you.
