不知欺詐含意 ?

在網上尋找 Sammi 演唱會飛, 結織了她, 她說有內部飛多張, 用原價高多 $50 賣給我, 見內部飛啲位實會正啲, 於是我及幫朋友買了十張, 她承諾要在2014年11月中給現飛我, 需給了訂金 $4,566 給她作訂飛之用, 但到了11月中, 拖到12月頭, 到開演唱會前一星期都沒有現飛給我, 她說叫我及我朋友在其他網上買飛, 買飛費用她承諾由她負責, 於是我及我朋友在網上賣了黃牛飛, 合共24,700, 連訂金合共 29,266, 跟住追討她負責飛費用, 她反而話因欠3千蚊才可唔 hold 銀行戶口才有錢還給我, 我話我都無錢, 最後我只能再借$1200 給她, 希望她唔給銀行 hold 戶口, 希望她還番哂啲錢給我地, 一拖拖到現在仲未還, 連訂金都未還, 但我要求她寫了一張借據,不是正本,借據上寫明若她不還款會交由警方負責, 我只有她的手提電話, 英文姓名, 身份證號碼, 地址沒有, 請問警方會受理嗎 ? 可告她欺詐嗎 ? 可以有咩方法追討呢 ?

根據遊樂場條例,你地之間既買賣本身已經違法,譬如咁講,買私煙比人走數,你話警察理唔理呢?以你既描述,欺詐並唔成立,先講訂金部份,你係要證明到佢本身由始至終都係冇諗過賣飛比你,欺詐先可能成立.
然後係借左1200蚊比佢,唔好意思,借錢唔還唔算係刑事.
