租緊居屋,業主未補地價

朋友同業主簽左一年生約,一年死約,岩岩過左一年生約,佢有朋友話原來做左厘印,唔等於補左地價,但當初業主講話補左地價,會做埋厘印,我朋友就信左佢。
所以我朋友就查左土地發記册,發現真係無補,我想問下,我朋友應該點做?如果我朋友而家先知道真相而即刻唔租,佢使唔使負上法律責任?佢可唔可以追討番過去一年既租金?因為業主明顯欺騙了佢!

法律界既人士。。。幫幫手!

1. It really depends on your friend's desire.

2. No - the owner(s) is always the responsible party.

3. No. The lease is against the public policy, so the lease can be voided. However, it does not mean your friend can get the money back.

Simply saying, your friend has 2 choices - moving out or staying. Either cases, your friend won't be able to get any money at all.

Then you should report to the Housing Department then.

Suing the owner will not resolve any issues.

Man Hong 你好!其實兩位網友的意見都算正確,尤其是第二位所指請令友即時遷出及令友無法證明自己不知所租處未補地價!更較第一位所言可續居為佳,因為之前說不知租住還可以,但已知後還續居?!
