居英權護照問題

本人於1992年獲得居英權(Certification of registration as a British Citizen)並申請了英國公民護照。本人與太太於2000年結婚。太太在香港出世，現時持有有效之香港特區護照及己過期之BNO護照。請問本人太太可否根據英國國籍法(British Nationality (Hong Kong) Act 1990) 之 section 1(4) 而獲得英國公民護照？

不能，你本身須先在英國連續居住最少三年，證明有在英國繳稅完成英國公民責任之後，才正式成為英國公民，之後你才可以申請你太太移民英國。

The answer is no.
Section 1(4) only applied when at the time of the registration, the spouse was also included in the application (by the recommendation of the Governor of Hong Kong).
In this case, the only way for your spouse to acquire British citizenship is actual immigration to the U.K.
