Why can some videos use copyrighted music material but others can't?

I live in the UK and I want to make a short dance video with Lorde's version of 'Everybody wants to rule the world' but I'm afraid to use it in case it gets muted or flagged. What I don't understand is that I've seen other dance videos that had popular music in them like Beyonce's 'Run the world' but they don't get flagged or anything. All they had was a standard You tube license or provided wrote the song and artist name in the title. I keep reading on the internet how my video will get flagged or muted if I use a copyrighted song but why are so many videos unaffected.

It is not "fair use" to distribute free copies of a copyrighted work to everyone in the entire universe. That would "eviscerate" the entire law for which the exemption applies. Unless you can PROVE that your particular use is actually "fair use", you can certainly lose your case in federal court when you violate a US copyright.

In fact, US copyrights are enforceable in over 160 countries, under the Berne Convention. The owners can sue you in any or all of them.

It truly depends on the Release location of the Audio track. the best you can do is upload it and include the "Fair Use" Paragraph in the description as well as give credits to the original author. And thats about as far as my knowledge goes unfortunately. And if you ask me its not right for Youtube to have Bias Audio removals such as they do. they need to either remove ALL audio.. or Remove NONE. not pick and choose because any audio from music is technically copyrighted material.
