如題！
上星期我去信和中心１２樓一間財務公司借＄，
兩面得兩個職員，經網上申請後已聯絡我幾日，成日打電話俾我叫我上去，
我已多次向對方係咪冇手續費，佢話係，會全數拎走，咁好啦，諗住佢分到期數多，我還得輕鬆，又試下啦！
點知一上去，填好表，印影Ｄ資料後就原形畢露，
一開口就話有幾個費用要收，
1) 印影費 $100
2) 行政費 $200
3) 外勤費 $400
4) 服務費 $1000 (呢個收費表示收到貸款額後扣返)
一心諗住算喇，幫到我周轉，俾佢啦！點知放低頭３項收費共$700後，叫我去金雞廣場再搞手續同埋拎$，當時我個心好唔舒服，覺得會俾人屈，到時果邊又話收咩費咩費，我死都唔掂啦！所以我決定算喇，唔借喇！就同對方講，我唔借喇，你俾返Ｄ$700我啦，對方當然唔肯，仲想屈我話簽咗同意書，唔申請都要俾埋$1000，我睬佢都傻，跟住走人。
尋日、今日間衰野都有不同既人打電話嚟叫我俾埋$1000，我問過警察，佢地話我有權唔俾，可以請對方民事索償追我，今日我收到電話時已經同對方講咗呢番說話，故事到呢到，我有以下問題想請各位法律界高手為我解難:
1)既然我已表明態度，亦請對方不要再打嚟騷擾我同家人(佢已經打過電話俾我爸爸)，如果佢地再打嚟，我係咪有權報警話佢騷擾我？
2)雖然我唔認為佢地真係會為一千蚊而告上法庭，但如果真係告上去，我有合理理由不支付嗎？會否敗訴？
請各高手為我解難，感激！

1) 電話騷擾當然可以報案, 如果對方帶有恐嚇成份, 警方一定處理, 若財務公司來電時, 你可向他表明已錄音及準備往報案, 相同對方會知難而退的;2) 法庭是講求證據, 單憑口講而沒有文件證明財務公司胡亂收費, 法官是不會接納的, 在沒有證據情況下, 你根本沒有可能告上法庭, 就算有證據, 最後也得不償失, 堂費加上律師費也不夠的。

個原理就咁,你仍然係未比手續費,手續費係不論你有冇借都可能要比,然後就將呢條數轉去比追數公司,咁一去到追數公司,咁緊係又幾千蚊追數費啦,計埋利息,循環不息.
1. 假如佢地係有目的咁打比你,唔算係騷擾,基本上亦唔會一日幾廿個電話.
2. 點會告上法庭,佢地會有更有效益既方法去處理.

1. Why don't I put it this way - you have the right to contact the police regardless what happens. The only matter is will the police help you or simply take down the information for the record.
Harassment is not a criminal offense in Hong Kong. So the police can't really do anything unless you or your family have been threatened (and trust me - those people know how to speak to avoid this).
An injunction is the only ultimate way to stop these calls.
2. Yes under Trade Descriptions Ordinance (Hong Kong Ordinance Chapter 362).
Money lenders are financial service providers. However, they are not banks, which they are not exempted from the Ordinance. Since the lender says this and do that, it is possible that it can be a violation of the Ordinance and the lender can face criminal prosecution.
Your chance of success depends if the court accepts your defense.
(Seriously - since it is a Small Claims case, companies will file cases even the amounts are small.)
