破產令一半業權由破產管理局持有

有關破產問題:


請問有間公屋自購咗,姐夫破產令一半業權由破產管理局持有,另一半由姐姐持有,姐夫破產時限4年已過,而家想還款大既40萬,原本借貸19萬,再加 8年時間每年利息8厘,而变成40萬,早知一早還咗佢,真系蠢!!而家想還清条數,自己可否同債權人( 銀行+ 財務公司)講數用每年8厘利息還償,因問過律師,幫我同債權人傾數,要收手續費4-5萬,好鬼貴!我吾用律師,自已做得吾得?有乜野要特別注意及點樣同債權人傾,請高人指點迷津!




另如果還咗款,个半層楼是歸我姐姐?定姐夫?定幫手還款的人即系我?个半層樓可否轉名比我或我d细路?甘要吾要先補地價才可轉名?但遲d樓價会可能跌,甘而家補現時地價咪好蠢咗!又或者叫姐姐納定遺囑比我d細路得吾得?但寫明間屋不能二按,以保障我權益!因我不想做業主。但我知將來姐姐走咗後要納遺產税,甘咪得不償失?所以而家吾知点做?請各路高人指點!Thx!

1. Sorry, but you are too late.

a. All debts have been discharged. Your brother-in-law does not owe banks anymore. All the damages have been done.

b. Even if you could reverse the whole bankruptcy (which you couldn't), banks will not accept 8% APR for sure. Without the bankruptcy, the amount should have been at least doubled from current amount. Bankruptcy actually has helped to lower the interest rate.

Paying that $400,000 is simpler.

2. Your sister, as the right to acquire is given to your sister.

3. Yes with market difference.

4. You can. But what's the point?

5. Estate tax has been canceled.

My suggestion - get the Official Receiver off your back first.

你子女不是直屬,需先搞掂銀行,再補地價

繼承權(不補地價)也有先后

1:配偶


2:子女

3:父母



如1還在,咁只有1可免補地價
