租約印花稅一問

本人有一問題想找人解答:
現本人租住一個朋友屋企的房間, 租金固定$4000. 但物業不是他本人, 因私人問題自己需要交出證明文件說明自己每月交租.
1. 租約格式應如何?
2. 如果本人單方便去加蓋印花稅, 我朋友是否需要報稅呢? (已通知我朋友, 如果要報稅, 到時交額外稅款時,我替他交)
3. 真正業主會唔會有影響?

承第3題, 我需要通知業主嗎? 及如果打印花稅既話,我得普通一張租金單據,而且收款人是寫我朋友名,我可否在打印花稅時用我朋友名?

1. There are standardized lease in a stationary store. Simply buy one and cross out any part not applying to you.

3. Definitely yes. Property tax is assessed to owners of rental properties.

1. Your friend should, not you (since you don't deal with the owner).

2. Only the contract can be processed for stamp duty. And IRD does not care about the name, but simply the money.

1. Get a standard tenancy agreement from a bookshop. Change the wordings to suit your case.
2. 我朋友是否需要報稅呢? Yes
3. 真正業主會唔會有影響? No
4. 我需要通知業主嗎? No
5. 印花稅 is stamped on the tenancy agreement, not the receipt.
