Can I get arrested for using someone else's wifi?

I recently moved and the apartment complex I live in doesn't have free internet and I can't afford to get it right now. I was looking for a network that doesn't have a password on my iPod a few weeks ago and I found Netgear. The connection isn't good though because it goes in and out and is very slow sometimes. No one has found out about this yet. I only use it to check my emails and go on Facebook sometimes. I'm not using it all day. I don't use this connection on my laptop, just my iPod. I want to know what the consequences are if I get caught? Will I get arrested? What should I tell the police or the owner of this network if it comes to this? Will I still get in trouble if I stop using it now?

Technically it is stealing. Yes, they could gather evidence on you using their router and internet connection and pursue you in small claims court. But that would take money and they would have to hire a lawyer, etc etc.

Most people aren't going to go through all that work just to retaliate against a teenager who is using their internet!
Even if you went up to them and told them "hey, im using your internet!", I think the response you would get from them would involve a furrowed brow and them saying "well stop that!", and then they would probably close their door on your face, and block you on their router, and that would be it.

If you are torrenting or downloading illegal content on their router, and they get in trouble for it, then you might have problems. Or if you hack their router password, then you might have problems too. But dont sweat the small stuff. Just don't use up the bandwith and you should be fine.

If it a un-locked network it's perfectly legal to use.

Could you? In theory. It's certainly an offense. But the odds of it actually being caught and traced are low absent some particular conduct.

It is, strictly speaking, theft.
If the owner of that network is paying for a download-limited service, they could (I would) get very angry about someone else using the capacity and that just may see someone knocking on your door if you don't stop.
How would you feel if it were your wi-fi someone else was slowing it down or even stopping it?

An unprotected network is often reffered to as open which suggests that anyone can use it. And it is the fault of the network owner for not securing his network. You are not hacking their network as its unsecured. They would never be able to trace the person connecting back to you anyway.
