全新村屋, 執漏期發現外牆漏水, 發展商整極都唔好, 點算?

請問我新買的全新村屋, 4月7日收鎖匙, 原定有一個月執漏期, 但在執漏期間發現外牆漏水, 至今發展商整極都唔好, 可以點算?

我已打電話去過食環署的滲水辦, 民政事務署, 一手物業銷售監管局, 地政署, 都回覆幫不了忙.

本人11月底結婚, 趕著要裝修, 但師傅話唔先攪點漏水, 唔敢開工.

請問大家有什麼好建議?

Your situation is basically beyond the point that you definitely need some professional legal assistance.

You should look for a lawyer, as:

1. A demand by a law firm (retained by you) can ensure you are protected. At the least, it is not difficult to imagine that you are affected (such as paying mortgage while paying rent), which a lawyer can help you to seek reimbursement from the developer.

2. As a newly-built property, unless you have done anything in alternating the structure (which is unlikely in this case), the developer will basically have the sole responsibility. In other word, if this case ends up in the court, the developer is definitely going to lose. The only matter is how much.

A demand by a law firm will definitely give them a wake-up call.

3. Even you may not elected to the legal option, an adjuster or building inspector is most likely needed in your case to determine the cause and damage. This is going to cost you. A lawyer should be able to get the developer to pay for these services.

No one has asked you to sue the developer.

You simply use a lawyer to press on the developer. A demand or letter from a law firm will push the developer to work on the issue.

The developer simply needs an authority to push to work.

這麼集中的滲水地方發展商執極都唔掂?
如果我看過,一定能替你解決問題!
而且1-2天就可搞掂!(看過不用搭棚的話!)
執漏水是一門學問,不是一般普通CF可以順任的!

你漏水係點樣定義﹖ 你係落雨漏水,抑或你見到有水由牆身流出,係牆內或牆外﹖ 如果係咁,你只係爆水喉,閂大掣就知道,有何難﹖

漏水最難唔係做,而係搵出源頭.

以我經驗計,你既情況應該係引水問題,所以發展商先攪唔掂,你應該先攪好問題然後裝修.

至於話唔收樓就難攪D,咁你每個月照供樓,但就唔去住,都冇人會反對.

我估係手工及用料差.....

我已多次向發展商投訴, 整過兩次, 但至今仍然漏水.....

律師唔建議打官司, 怕小型發展商會"走佬", 血本無歸

我的是村屋3樓連天台, 但是獨立樓梯上的.

現在漏水的地方, 是大閘及每層樓梯的窗台....

我看不見有水流出, 但牆身有水印, 油漆亦會樸起.

絕對不會是爆水喉!!!

Hi Gary,

I've contacted a laywer seeking for legal advice already.

However, since my flat is a 村屋 and the developer is small scale. If I put the case to the court, the developer may close the company. Then I need to suffer the legal cost as well. Also, it needs a long long time to go.

知5知到底咩原因導致漏水?如果知既話就同發展商講番個原因然後叫佢地去整番好,整唔好就唔收樓.
