如何追討大廈維修費

多次與住戶接觸商討不能達成共識, 因該住戶不是業主, 而是親友長期居住, 但實則單位業主巳過身達10年, 我們法團可否入稟小額錢債追討或將單位申請拍賣嗎?或是可該單位之住戶追收, 謝謝!

You should seek professional legal opinion in this case, given that you represent an owners' corporation, which the corporation should have a legal consultant.

Nevertheless, in my opinion, this is the situation which a lawsuit is not the best course of action.

In this case, since the original owner has deceased and the probate process is not completed, there will be no one responding the lawsuit and paying for the judgment. Even a default judgment allows the winner for a court-ordered sale, the cost and time, as well as any potential complications, will make this route difficult.

The easiest way is simply file a lien on the property to prevent any transactions. In this case, even someone want to inherit the property, they will have to pay to clear the mess.

建議你儘快找律師樓幫助,到田土廳註上欠債押記(ORDER),有了押記後,日後不論新舊業主需要轉讓也必須找你們先可清除押記,相信住客短期會向法庭申請"逆權侵佔",所以你一定要快手!

你可以嘗試入稟小額錢債追討,但小額錢債追討上限5萬,而你地法團作為申索人要負起舉證責任,你地可能要提供你地與住戶接觸既詳情,提供證據證明單位業主已過身達十年,如果冇就可以嘗試申請當佢係法律上死亡,但對方亦可以提出疑點,例如你點知佢死左?你搵到佢條屍咩?等等..如果你想將單位強制拍賣就冇咩可能,除非你入稟完小額錢債後獲判勝訴,到時就可以申請強制拍賣,如對方被判敗訴後仍不作出賠償你可以申請禁制佢地出境,勒令破產,強制要佢地還款或申請封票,但申請封票需另外俾封達主任車費,封票費用等等,但你地如果申請小額錢債你一定要有對方住址同姓名先得,得地址好似唔可以申請小額錢債的~
