One of the things people cheerfully forget or ignore is that when two people get married, they enter into a contract where all the assets and liabilities they had as single people become joint. This means that if one of them has huge debts, once married the liability for these is shared by both of them, so if the original debtor doesn't have the money, the creditor can come after their partner for the outstanding amount.
When two people divorce, the courts will split the net joint assets 50/50 but will then make provision for any child support.
IF they are married then she is 'usually ' entitled to half of the value of the house
when it is sold
However she may agree to hubby staying in the house and bringing up the children there
but she does not have to agree to that
its up to the court but if he has custody of them most of the time he needs to have a place for the kids and him to live..if the mum has no custody or just weekends then she should leave. discuss with a solicitor.
no she should not get half, she should get every bit of it, it is one hell of a job raising children and supporting them while some deadbeat who could care less whether the children eat or not lays on his butt.
